Sam is away for a week so it would be easear to deal with this at later date ,it would be unfare to assume we have to pay for soliceters costs as Tuscan and Connel have been funded by Mother for the period recagnised And as far as Sam new she never had to pay exspences

As discussed, in the event of your divorce action being dismissed (which is what you want) Sam’s solicitor expects that an award of expenses would be made in Sam’s favour. In circumstances where a party raises an action and later dismisses it, it would not be unusual for the defending party to be awarded expenses to take account of the costs they (or in Sam’s case the legal aid board) have incurred.

 

If you do not agree to the award of expenses, Sam’s solicitor will ask the court to grant such an order and that will be decided by the sheriff. I have attached an email received from Sam’s solicitor today, stating that she expects to hear from us within 7 days. If she does not, she will ask the court to dismiss the case but also ask for an award of expenses.

 

As I mentioned, I have asked a colleague to take a look at your file and give an indication as to what the level of expense might be. Also, as authorised by you, I will make contact with your mum to discuss this matter with her.
